Rights of Foster Parents
In numerous instances, foster parents have spent many years caring for, loving and looking after the needs of a child, all while forming strong emotional bonds. Their depth of understanding and insight into the physical, emotional and social development of the child often provides valuable information for the courts. Based on this experience, the court respects their knowledge and their concerns when making childcare judgments. While foster parents do not share the same rights as biological parents in dependency disputes, they have the right to express their views and testify at hearings. In certain stages of dependency hearings, foster parents may be able to qualify as “De Facto Parents” which allows them to participate in Court Hearings as a party, and to be represented by an attorney.
In some cases because of the inherent ties developed through years of care and the stability created for the child, the courts grant foster parents the right to adopt a foster child. Additionally, loving relationships often encourage caretakers to take the necessary steps toward adoption. There may also be opportunities for Guardianship of the Child.
